FDNext Further development of research data practices: Tools for quality development for service facilities in cooperation with departments and research networks – Subproject Concepts and competencies for FD legal advice

The subject-specific legal questions posed by researchers and the high level of legal complexity require qualified support services, clarification mechanisms, and dedicated expertise as an integral part of FDM. Based on questions that regularly lead to legal uncertainties typical of data and methods, AP4 aims to develop the concept of first-level legal support. This is intended to reduce uncertainties in dealing with research data and research data repositories.

In AP4, it will be developed – as far as necessary, on a model basis for specific disciplines – to what extent first-level legal support could be structured and reliably provided by FDM staff from libraries, computer centers, and research management. To this end, guidelines and recommendations will be drawn up on how to meet the organizational requirements for such first-level legal support, e.g., at a university. In close cooperation with the other APs, guidelines for building legal competence among FDM staff will be developed.
The legal competence of the first-level legal support service is also ensured by its links to other central offices at the university. The work package will therefore define the interfaces between the first-level legal support service and, for example, the official data protection officers, legal departments, professional associations, and research and technology transfer departments, and recommend suitable cooperation mechanisms.
