Data categories

We collect the data that you send or communicate to us in connection with your application, in particular by post, e-mail, telephone or personal interview. Depending on the information, data concerning special categories (Art. 9 DSGVO) will also be processed, e. g. in case of severe disability.

For what purposes is the data processed?

We process your data in order to check your suitability for the position and to carry out the application procedure.

What is the legal basis for the processing of data?

The legal basis for the processing of your personal data in this application procedure is Art. 6 para. 1 b), Art. 88 DSGVO in conjunction with § 18 BlnDSG, §§ 26, 32 to 37, 41, 43 and 44 BDSG. It allows the processing of data relevant to the decision-making procedure concerning possible future employment.

Further processing will only take place if you have given your consent or if legal permission has been obtained, e. g. the safeguarding of legitimate interests pursuant to Art. 6 para. 1 f DSGVO. The interest then consists in the assertion or defence of claims.

Who has access to your data?

Your data will only be used internally. In the case of calls for applications for posts in cooperation, clusters or alliances with other research institutions, the competent bodies there are regularly involved in the procedure, so that in this case the applicant's data are transmitted to them.

Applicants are selected decentrally by the department issuing the invitation to tender. The contact persons are listed  in the job advertisement.  As a matter of principle, only those persons have access to your data who need it for the correct conduct of the application procedure. In addition to the specific department, these include, in particular, the staff council, the women's representative, if applicable, the representation of severely disabled persons, if applicable, the youth and training representative, as well as, if applicable, other competent bodies.

Is your data transferred to a third country or to an international organisation? The data will not be transferred to a third country or an international organisation.

How long is your data stored?

If your application is successful, we will transfer your data to our personnel administration system. In the event of rejection, applicants' data will be deleted no later than six months after the end of the application procedure.

Is there an obligation for you to provide data?

The provision of your personal data is voluntary, there is no obligation to provide data. However, should your application documents be incomplete, this may have a negative effect on the success of the application.

What data protection rights do you have?

Should your personal data be processed, you have the right to access this information (Art. 15 DSGVO, § 34 BDSG ).

Should incorrect personal data be processed, you have the right to correction (Art. 16 DSGVO).

Should the legal requirements be met, you can demand that the processing be deleted or restricted (Art. 17 and 18 DSGVO, § 35 BDSG).

Under certain circumstances, you have the right to transfer the personal data which you have provided to us in a structured, common and machine-readable format if the processing is based on consent or a contract and is carried out with the aid of automated procedures (Art. 20 DSGVO).

You have the right, for reasons arising from your particular situation, to object at any time to the processing of your personal data on the basis of Art. 6 para. 1 letter e DSGVO and Art. 6 para. 1 letter f DSGVO (Art. 21 DSGVO, § 36 BDSG). If you file a legitimate objection, your personal data will no longer be processed unless we can prove compelling legitimate reasons for the processing that outweigh your interests, rights and freedoms, or the processing serves the assertion, exercise or defense of legal claims.

The appeal may be lodged without any formal requirements. For verification purposes, we ask you to notify us of your objection by post or e-mail. Please use the subject line "Objection".

If you exercise any of the above rights, we will verify that the legal requirements are met and notify you accordingly. If necessary, we will ask you to identify yourself; we are obliged to do so if there are any doubts.

If you are of the opinion that the processing of your personal data violates data protection regulations, you have the opportunity to lodge a complaint with a data protection supervisory authority, for example the State Commissioner for Data Protection and Freedom of Information Berlin (Art 77 DSGVO).
